DWI:  Refusing the Breath Test


The results of breath test are the most potent piece of evidence the State has in a DWI/DUI case. So why take the breath test in the first place? The reason most drivers submit is the consequences for refusing.

Refusal to take a breath test in a DWI case will result in a one year drivers license suspension. One important distinction to make here: the one year suspension is only triggered by refusing to submit to the Intoximeter IC/ECR II machine after you are arrested. Refusing to take a portable breath test on the side of the road does not suspend your drivers license.
